What a Licensed Illinois Private Investigator Can and Cannot Legally Do
One of the most common questions people have before hiring a private investigator is what the investigator is actually allowed to do. Television and film have created a distorted picture — investigators in popular culture tap phones, break into properties, and access confidential records at will. Real professional investigative work operates within a defined legal framework, and understanding that framework helps clients know what to expect.
Illinois has clear laws governing private investigative work. Operating within those laws is not a limitation — it is what makes the evidence gathered legally defensible.
What a Licensed Illinois Private Investigator CAN Do
Conduct surveillance from public spaces or any location where the investigator has a legal right to be. This includes public streets, sidewalks, parking lots, parks, and any area accessible to the general public. Filming activity visible from these locations is entirely legal.
Conduct database research using professional tools that aggregate public records, address histories, vehicle registrations, property ownership, court records, business filings, and other legally accessible information.
Conduct background investigations using publicly available information and professional database tools. This includes criminal history, civil court records, bankruptcy filings, professional license verifications, and employment history verification where legally permissible.
Serve legal process — subpoenas, summonses, complaints, and other court documents — throughout Illinois. Illinois law allows licensed private investigators to serve process statewide.
Interview witnesses and individuals willing to speak voluntarily. Investigators can speak with anyone who agrees to be interviewed — they cannot compel anyone to speak with them.
Conduct open-source intelligence research — reviewing publicly available social media, public posts, business listings, news coverage, and other information that is accessible without accessing private accounts or systems.
Take photographs and video in public spaces and from public vantage points. Photography in public is legal. Documentation of activity visible from public areas is legal.
What a Licensed Illinois Private Investigator CANNOT Do
Access private accounts — email, social media, financial, or otherwise — without the account holder's authorization. This includes using another person's login credentials or accessing accounts through unauthorized means.
Intercept private communications. Recording phone calls without the consent of at least one party to the call is a violation of federal wiretapping law. Illinois is a one-party consent state for recorded conversations, but intercepting communications without being a party to the conversation is illegal.
Trespass on private property. Surveillance must be conducted from legally permissible locations. Entering private property without authorization to conduct surveillance is illegal regardless of the purpose.
Impersonate law enforcement or government officials. Misrepresenting oneself as a police officer, federal agent, or government official to obtain information is a criminal offense.
Use illegal pretexting. While investigators may conduct interviews and ask questions, using false identities or misrepresentations to obtain protected financial or medical information is prohibited under federal law.
Access non-public government databases, medical records, or financial records without proper legal authorization.
Why Licensing Matters
Illinois requires private investigators to be licensed through the Illinois Department of Financial and Professional Regulation. Licensed investigators carry professional liability, operate under a code of conduct, and produce evidence that courts recognize as professionally gathered.
Evidence collected by an unlicensed individual is vulnerable to legal challenge on its face. Working with a licensed investigator protects the integrity of the evidence and the legal position of the client.
